Privacy Policy - Trevor Killeen Ltd. T/a TK Aesthetics / TK Wellbeing

At Trevor Killeen Ltd. we are committed to protecting your privacy and security of your personal information. Our responsibilities are set out under the General Data Protection Regulation and Data Protection Act 2018. This privacy statement sets out the way we collect and hold your personal data. This policy along with our cookie policy and terms and conditions cover our relationship with you as a user of the website, customer and client.

Under the GDPR guidelines we act as “data controller” and in that role we determine the manner in which your personal data is or is to be processed. We or other parties contracted to process your data will be known as “data processors”. You the individual who is the subject of the data with be known as “data subject”.

Data Protection Principles:

  • Purpose limitation – we must only collect personal data for a specific, explicit and legitimate purpose. We must state this purpose clearly and only collect data for as long as it is necessary to complete this purpose.

  • Accuracy – we must make every effort to ensure that data is kept up to date or remove data that is inaccurate or incomplete. You have the right to request that any erroneous data is rectified or erased. This must be done within a month of the request.
  • Storage limitation – The data should only be kept for as long as necessary for the purposes indicated. Some timescales will be set by regulatory requirements.I

How is your personal information collected?

We (or third parties) collect personal information about website users, customers and clients through the website, appointment booking system, payment system, account creation process, mailing and newsletter lists, sales and sales processing, consultations (online/one-to-one/by telephone) and treatments. 

We will only use your personal information in line with the law. We will use your personal information in the following circumstances:

  • Where we need to use it in the execution of the contract we have entered into with you.
  • Where we are required to comply with a legal obligation
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
  • Where you have given us your express consent to do so.

Your personal information may also be used in the rare circumstances where we may be required to protect yours or someone else’s interests, for official purposes or is in the public interest.  

We reserve the right to anonymise your data to obtain analysis while retaining your privacy. 

Some personal data is collected from the forms you complete, surveys, correspondence and telephone calls and details of your visits to our website, including but not limited to personally information like internet protocol (IP) addresses. We may collect statistics about the behaviour of the visitors to our sites.

If you fail to provide personal information:

If you fail to provide the information we have requested, then we may not be able to perform the contract we have entered into. This includes providing services, products or benefits. We may also be unable to comply with our legal obligations.

Duty to inform us of changes

It is important to keep your information that we hold on you accurate and up-to-date. Please keep us informed of any changes in your personal information including any changes in your medical history that may pertain to treatments.

How do we handle your information?

Any information that is provide in a paper-based form is secured in a locked, purpose made container which is stored in a locked premises. Access to this is limited to practitioners and employees of Trevor Killeen Ltd. for legitimate purposes.

Digital photographs or completed online consent forms are printed and stored securely as outlined above. Photographs are then transferred to an encrypted storage device.

We use third parties to securely process our online consultation forms, mailing lists, sales orders and payments. These third parties have their own privacy policies, terms and conditions and cookie policies. These are GDPR compliant and processing of your data through them will be governed by their policies. You may be asked to accept their terms and conditions at the time of the use but you must ensure that you are satisfied with their terms and conditions before using their services.

Access to any information is only granted to practitioners and staff of Trevor Killeen Ltd. for legitimate purposes.

Retention Policy

Trevor Killeen Ltd. will process your personal information / data during the duration of any contract. Your data and personal information will be stored for seven years after the contract is complete. This is to comply with legal and financial obligations and includes any digital imaging taken for the purpose of treatment record and/or assessment. Digital imaging forms part of our contract with you and your medical history. Any personal data not required after two years will be deleted.

To whom may we disclose your information

In providing your data and information you are agreeing that we can disclose your information for the purposes that we have outlined in this policy to our employees, agents representative and any data processors contracted to process the data on our behalf including third parties. 

We will share your personal information with third parties where we are required to by law. 

Change of purpose

We will only use your personal information for the purposes for which we have collected it or if we reasonably consider that it be used for another purpose that is compatible with the original purpose. We will notify you and explain the legal basis for any use which is unrelated to the original purpose. Please note that we may process your personal information without your knowledge or consent in compliance with the above rules, where this is required or permitted by law.

Cookies

Trevor Killeen Ltd. websites may use cookies to distinguish you from other users. This is a string of information stored on a visitor’s computer and that the visitor’s browser provides to the website every time the visitor returns to the site. You may choose to accept or decline cookies by modifying your own browser settings.

Your rights over your personal data:

1. To access personal data we hold about you

2. To correction of or erasure of data that is incorrect, out of date or incomplete providing it does not conflict with a legal obligation to retain the information (e.g. retention of financial and medical records)

4. To request that we stop any consent-based processing of your personal data if and after you withdraw that consent including the publication of any photographic images

You will not have to pay a fee to access your personal information. You may however have to provide information to allow us to identify you and confirm your right to access the information .

We reserve the right to update this privacy notice at any time by updating this page. Please check this notice each time you would like to use our website or services to ensure you understand the terms that apply at the time.
